What is the Freedom of Information Act? (FOIA)

FOIA is the state Freedom of Information Act. Under the Illinois Freedom of Information Act (ILCS 140), records in possession of public agencies may be accessed by the public upon written request. [Illinois FOIA statute] Pursuant to 5 ILCS 140, Section 2 (c), a public record is any records, reports, forms, writings, letters, memoranda, books, papers, maps, photographs, cards, tapes, recordings, electronic data processing records, recorded information, and all other documentary materials, regardless of physical form or characteristics, having been prepared or having been or being used, received, possessed or under the control of any public body.

How to Contact IEMA

Illinois Emergency Management Agency, or its more commonly used acronym IEMA; is an agency designed to enhance the organization for Illinois if a situation of emergency were to occur. These emergencies can range from natural and industrial disasters or hazards; as well as any risks in acts of terrorism. IEMA is functioning at all times to serve as a quick response to any emergency by keeping an emergency operations center which is always online and sends out quick notifications. The emergency operations center's main duty is to respond to any threat or act of terrorism by utilizing the state's resources to counter the situation with the most effective possible methods.

Each IEMA program is relied upon for responses to a FOIA request. Prior to submitting a FOIA request you should reach the IEMA website information concerning the various programs of IEMA; your search may help you:

  1. To obtain information that is free and immediately available;
  2. To obtain information already available at a minimal fee;
  3. To contact IEMA program staff who can answer questions and assist defining your written information request;
  4. To contact other state agencies that may also have relevant information.

Submitting FOIA Requests

To access IEMA's information, a FOIA request must be submitted, the request can be sent by the following three methods:

  1. By printing out the FOIA request form, filling it out, and mailing it to the address:

  2. By filling out the FOIA request form and faxing it to the number (217) 524-3698, and addressing it to the FOIA officer.
  3. By completing the Online FOIA Request Form and then clicking the "Submit Request" button.

IEMA's Records

IEMA's public records are maintained and organized by each separate IEMA office by their programs, such as site location, facility name, grant/contract project, annual chronology, individual name, date, etc. consequently, it is more important to provide specific descriptive information when requesting information through the FOIA process in order to identify the appropriate IEMA office, file, database, archive, etc.

IEMA public records are also maintained in various media format that may include paper, microfilm, digital images, and computerized records, in certain situations information cannot be cost effectively extracted onto a paper or an electronic format. In these situations, special arrangements, such as onsite viewing, or your use of commercial copy vendors, may be necessary.
