Nuclear Power Plants Statutes

Listed below are the names of the Nuclear Power Plants Statutes, along with a synopsis of the statutory requirements, by which the Division of Nuclear Safety exercises, administers and enforces its rights, powers, duties and responsibilities.

ILLINOIS NUCLEAR SAFETY PREPAREDNESS ACT
[420 ILCS 5/1 - 5/11. Formerly Ill. Rev. Stat., ch. 111-1/2 , pars. 4301 - 4310]
The Illinois Nuclear Safety Preparedness Act provides that the Agency shall establish emergency response plans and programs to assess potential nuclear accidents, their radiological consequences and the necessary protective actions required to mitigate the effects of such accidents. The Act provides for the development of a remote effluent monitoring system capable of reliably detecting and quantifying accidental radioactive releases from nuclear power plants to the environment. The Act also provides for the development of an environmental monitoring program for other nuclear facilities. The Act authorizes the collection of fees to cover the cost of establishing plans and programs to deal with the possibility of nuclear accidents. The Act requires the owners of each nuclear power reactor to provide to the Agency all system status signals which initiate Emergency Action Level Declarations, actuate accident mitigation and to provide mitigation verification as directed by the Agency. The Act authorizes compensation to local governments participating in necessary emergency response planning activities and authorizes the Agency to develop an environmental monitoring program for nuclear facilities other than nuclear power plants.

ILLINOIS NUCLEAR FACILITY SAFETY ACT
[420 ILCS 10/1 - 10/7. Formerly Ill. Rev. Stat., ch. 111-1/2 , par. 4351 et seq.]

The Illinois Nuclear Facility Safety Act authorizes the Agency to enter into a cooperative agreement with the United States Nuclear Regulatory Commission to reduce the likelihood and severity of accidents at nuclear facilities within Illinois and to protect the health and safety of workers at nuclear facilities and private citizens who could be injured as a result of releases of radiation from nuclear facilities. The Act authorizes the Agency to implement a program consisting of one full-time Illinois resident engineer at each nuclear plant in Illinois.

BOILER AND PRESSURE VESSEL SAFETY ACT
[430 ILCS 75/1 - 75/16. Formerly Ill. Rev. Stat., ch. 111-1/2 , pars. 3201 et seq.]

The Boiler and Pressure Vessel Safety Act authorizes the Agency to enter into agreements with the United States Nuclear Regulatory Commission for the establishment of a coordinated and comprehensive program to minimize the risks posed by boilers, pressure vessels, and related components at nuclear facilities within the State. The Act provides that the Agency shall, in regard to boilers and pressure vessels at nuclear facilities, have the same authority and exercise the same powers and duties as the Board of Boiler and Pressure Vessel Rules and the State Fire Marshal exercise in regard to other boilers and pressure vessels. The Act provides that the Agency shall formulate definitions, rules and regulations consistent with nation-wide engineering standards, formulae, and practices pertaining to boiler and pressure vessel construction and safety.
